Terms of Service

Welcome to AutoContent. These Terms of Service (the “Terms”) are a binding agreement between you and AutoContent (“AutoContent,” “we,” “us,” or “our”) and govern your access to and use of the autocontent.social website, applications, and related services (together, the “Service”). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
If you use the Service on behalf of a business or other organization, you represent that you have the authority to bind that organization to these Terms, and “you” refers to that organization.
1. The Service
AutoContent is a software platform that ingests content you own or are authorized to use — such as your website, blog posts, articles, PDFs, transcripts, images, and brand assets — learns your brand voice, and generates draft social media content. With your authorization, it can also schedule and publish that content to third-party social media platforms you connect, and report engagement metrics on your posts. The Service relies on artificial intelligence and third-party providers to generate and deliver content.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for business use by small-business owners and their authorized team members.
3. Accounts and security
You can create an account with an email and password or by signing in with Google. You are responsible for keeping your credentials confidential and for all activity that happens under your account. Provide accurate information, keep it current, and notify us promptly at hello@autocontent.social if you suspect unauthorized use.
4. Subscriptions, billing, and cancellation
- Plans and fees. The Service is offered on paid subscription plans (for example, Starter, Pro, and Max). Current pricing is shown at sign-up and on our pricing page. There is no free trial — each plan is the full product from the first day.
- Billing and renewal. Subscriptions are billed in advance on a recurring basis (monthly, or as stated at checkout) through our payment processor, Stripe. Your subscription renews automatically at the end of each billing period until you cancel.
- Cancellation. You may cancel at any time from the billing portal. Cancellation stops future renewals and takes effect at the end of the current billing period; you keep access until then.
- Refunds. Except where required by law, fees are non-refundable, and we do not provide refunds or credits for partial periods or unused features.
- Price changes. We may change our fees with reasonable advance notice. Changes apply to the next billing period.
- Taxes. Fees are exclusive of taxes. You are responsible for any applicable taxes.
- Usage allowances. Plans include allowances such as the number of brand profiles or generated assets. Exceeding an allowance may require an upgrade.
5. Your content and inputs
“Your Content” means the material you submit, upload, connect, or direct us to ingest — including your website and its pages, blog posts, articles, PDFs, transcripts, images, brand assets, and the social accounts you connect.
- You retain all ownership of Your Content. You grant AutoContent a worldwide, non-exclusive license to host, copy, process, transmit, analyze, and create derivative works from Your Content solely to operate and improve the Service and to generate and publish content for you.
- You represent and warrant that you own or have all rights necessary to Your Content and to the websites and sources you direct us to ingest, and that our use of them as described will not infringe any third party’s rights or violate any law.
- You are responsible for the accuracy and legality of Your Content.
6. AI-generated output
- The Service uses artificial intelligence to produce draft captions, scripts, images, video, and other content (“Output”).
- As between you and us, you own the Output you generate, subject to these Terms and the terms of the underlying AI providers. Because of how generative AI works, Output may not be unique — similar content may be produced for others — and we make no guarantee of originality, accuracy, or fitness for any purpose.
- You are solely responsible for reviewing, editing, and approving Output before it is published. The Service is designed to require your approval before anything is posted. Verify facts, claims, and compliance with advertising, disclosure, and platform rules before publishing.
7. Third-party platforms and services
The Service integrates with third-party social media platforms (such as Instagram, TikTok, Facebook, YouTube, LinkedIn, and X) and other third-party services. When you connect an account, you authorize us to access and act on it as needed to provide the Service, including publishing on your behalf through our publishing provider and retrieving metrics on your posts.
Your use of those platforms is governed by their own terms and policies, and you are responsible for complying with them. We are not responsible for third-party platforms, their availability, or actions they take on your account, such as removing content or suspending access.
8. Acceptable use
You agree not to use the Service to:
- violate any law or any third party’s rights, including intellectual property rights;
- generate or publish content that is unlawful, defamatory, deceptive, harassing, hateful, or sexually exploitative;
- spam, or engage in deceptive, fraudulent, or manipulative practices;
- impersonate any person or misrepresent your affiliation;
- upload malware, or attempt to disrupt, reverse engineer, scrape, or gain unauthorized access to the Service or its systems;
- resell or provide the Service to third parties other than your authorized team, or use it to build a competing product.
You must also comply with the acceptable-use and content rules of any platform you connect.
9. Intellectual property
The Service — including its software, design, and trademarks — is owned by AutoContent and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service during your subscription. If you send us feedback or suggestions, you grant us a royalty-free, perpetual license to use them without restriction.
10. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to us, other users, or third parties. When your access ends, your right to use the Service ends; we may delete Your Content after a reasonable period, subject to our Privacy Policy and our legal obligations.
11. Disclaimers
THE SERVICE AND ALL OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT OUTPUT WILL BE ACCURATE, OR THAT CONTENT PUBLISHED THROUGH THE SERVICE WILL ACHIEVE ANY PARTICULAR RESULT.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUTOCONTENT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR USD $100. Some jurisdictions do not allow these limits, so they may not fully apply to you.
13. Indemnification
You agree to indemnify and hold harmless AutoContent and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
14. Changes to the Service and these Terms
We may modify the Service and these Terms from time to time. If we make material changes to the Terms, we will provide notice — for example, by email or within the app — and update the “Last updated” date above. Your continued use of the Service after changes take effect means you accept the revised Terms.
15. Governing law and disputes
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. The state and federal courts located in California will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to venue there — except that either party may seek injunctive relief in any court of competent jurisdiction.
